1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“User”, “you”) and Macksons Power and Energy (Pvt) Ltd (“Company”, “we”, “us”, or “our”), a subsidiary of Macksons Holdings.

By accessing the Mackvolt mobile application (the “App”) or using our physical electric vehicle (EV) charging stations, you agree that you have read, understood, and agreed to be bound by all of these Terms and Conditions.

 

2. Eligibility & Account Registration

  1. Age Requirement: You must be at least 18 years of age and hold a valid Sri Lankan driving license to use the Mackvolt charging services.

  2. Account Accuracy: You agree to provide accurate, current, and complete information during registration.

  3. Account Security: You are responsible for safeguarding your login credentials. Under Central Bank of Sri Lanka (CBSL) guidelines for mobile payments, you must enable Multi-Factor Authentication (MFA) if prompted by the App.

 

3. Charging Services & User Conduct

  1. Usage Guidelines: Users must follow the instructions displayed at each Mackvolt station. You are responsible for ensuring that your vehicle is compatible with the charging equipment (e.g., Type 2, CCS2, or CHAdeMO).

  2. Safety Precautions:

    • Do not use the charging station if the cable or connector appears damaged.

    • Weather Warning: In accordance with local safety standards, we strongly advise against charging during active lightning or severe thunderstorms, which are frequent in Sri Lanka.

  3. Parking Regulation: Charging spots are strictly for active EV charging. Non-EVs or EVs not actively charging may be subject to fines or towing at the owner’s expense as per station site rules.

 

4. Fees, Payments, and Taxes

  1. Tariffs: Charging fees are calculated based on the energy consumed (kWh) or time duration, as displayed in the App. These rates are subject to change in accordance with PUCSL regulated electricity tariffs.

  2. Idle Fees: To ensure station availability, Mackvolt may charge an “Idle Fee” if your vehicle remains connected 15 minutes after the charging session has ended.

  3. Currency & Taxes: All transactions are processed in Sri Lankan Rupees (LKR) and are inclusive of applicable government taxes (VAT, SSCL, etc.).

  4. Payment Processing: Payments are facilitated through secured Sri Lankan payment gateways. Mackvolt does not store full credit/debit card details on its servers.

 

5. Liability & Disclaimers

  1. No Warranty: While we strive for 100% uptime, Mackvolt services are provided on an “as-is” and “as-available” basis. We do not guarantee uninterrupted service during national grid failures or CEB/LECO power cuts.

  2. Vehicle Damage: Macksons Power and Energy (Pvt) Ltd shall not be liable for any damage to your vehicle, its battery, or software, except where such damage is a direct result of proven equipment malfunction or gross negligence by our staff.

  3. Indirect Losses: We are not responsible for any indirect, incidental, or consequential damages, including loss of profit or “range anxiety” resulting from a station being offline.

 

6. Intellectual Property

The “Mackvolt” name, logo, App code, and all related branding are the exclusive property of Macksons Power and Energy (Pvt) Ltd and Macksons Holdings. Unauthorized use, reproduction, or “scraping” of station data is strictly prohibited.

 

7. Termination

We reserve the right to suspend or terminate your account without notice if:

  • You violate these Terms.

  • You engage in fraudulent payment activity.

  • You misuse or intentionally damage Mackvolt physical equipment.

 

8. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka. Any dispute arising out of these Terms shall first be attempted to be resolved through mediation. If unresolved, the dispute shall be subject to the exclusive jurisdiction of the courts in Colombo.
